1. Introduction and Acceptance of Terms

Welcome to ExperiaHub (the “Platform”), operated by [Your Company Legal Name, e.g., GlobalExperia Co., Ltd.], a company registered in Taiwan (“we,” “us,” or “our”). ExperiaHub provides an online platform that connects travelers (“Users”) with independent third-party activity and tour providers (“Suppliers”) offering unique and authentic experiences (“Activities”). Our AI Concierge assists Users in discovering and selecting Activities.

By accessing, browsing, or using our Platform, including making any bookings for Activities, you agree to be bound by these Terms & Conditions (“Terms”), our Privacy Policy, and all other policies referenced herein. If you do not agree to these Terms, you must not use our Platform.

2. Definitions

  • Platform: Refers to the ExperiaHub website and any associated services, features, or applications.
  • User(s): Any individual or entity accessing or using the Platform, including those who browse, create accounts, or book Activities.
  • Supplier(s): Independent third-party businesses or individuals who offer and provide Activities through the Platform.
  • Activity/Activities: The tours, experiences, classes, workshops, or other services offered by Suppliers and listed on the Platform.
  • Booking: A confirmed reservation for an Activity made by a User through the Platform.
  • AI Concierge: The artificial intelligence-powered recommendation system on the Platform designed to assist Users in finding Activities.
  • Bokun: The third-party booking management system used by ExperiaHub and/or its Suppliers to manage Activity inventory and bookings.

3. Services Provided by ExperiaHub

ExperiaHub acts solely as a facilitator and marketplace connecting Users with Suppliers. Our services include:

  • Displaying information about Activities provided by Suppliers.
  • Providing an AI Concierge to generate personalized Activity recommendations.
  • Facilitating the booking process for Activities via integration with third-party booking systems (e.g., Bokun).
  • Processing payments for Bookings on behalf of Suppliers.

ExperiaHub DOES NOT:

  • Own, operate, or provide any of the Activities listed on the Platform.
  • Act as a travel agent in the traditional sense, or as a direct provider of travel services.
  • Assume responsibility for the direct provision, quality, safety, or legality of any Activities. These responsibilities lie solely with the respective Suppliers.

4. User Obligations

By using the Platform, you agree to:

  • Provide accurate, current, and complete information during registration and booking.
  • Maintain the confidentiality of your account credentials.
  • Use the Platform only for lawful purposes and in accordance with these Terms.
  • Comply with all applicable local, national, and international laws and regulations.
  • Not engage in any activity that interferes with or disrupts the Platform’s functionality or security.
  • Be solely responsible for ensuring that any Activity you book is suitable for your needs and abilities.

5. Booking Process

  • Activity Information: While we strive for accuracy, Activity information (including descriptions, prices, availability, and images) is provided by Suppliers and may be subject to change.
  • Booking Confirmation: A Booking is confirmed only when you receive a confirmation email from ExperiaHub (or Bokun on our behalf) after successful payment.
  • Contract with Supplier: When you make a Booking, you enter into a direct contract with the respective Supplier for the provision of the Activity. ExperiaHub is not a party to this contract.

6. Pricing and Payment

  • Pricing: Activity prices are set by Suppliers and displayed on the Platform. Prices may be subject to taxes, fees, and currency conversion rates.
  • Payment: Payments for Activities are processed securely through third-party payment gateways integrated with Bokun. By providing payment information, you authorize ExperiaHub (or its payment processor) to charge the full amount for your Booking.
  • Currency: All prices are displayed in United States Dollars (USD) unless otherwise specified.

7. Cancellations and Refunds

  • Supplier Policies: Each Activity has a specific cancellation and refund policy set by the Supplier. These policies are clearly displayed on the Activity detail page. By making a Booking, you agree to the Supplier’s cancellation policy.
  • ExperiaHub’s Role: ExperiaHub facilitates the processing of cancellations and refunds in accordance with the Supplier’s stated policy. We do not issue refunds beyond what is stipulated by the Supplier’s policy.
  • Full Refund Policy: For most experiences, a full refund is available if you cancel at least 24 hours in advance of the scheduled Activity start time. Specific exceptions will be noted on the Activity detail page.

8. Supplier Terms

Suppliers using the Platform are subject to separate Supplier Agreements that govern their relationship with ExperiaHub, including terms related to Activity listings, commissions, payments, and quality standards.

9. AI Concierge Usage

  • Recommendation Tool: The AI Concierge is an assistive tool designed to provide personalized Activity recommendations based on your input and available data.
  • No Guarantee: While we strive for accuracy and relevance, AI recommendations are generated by an automated system and do not constitute a guarantee of suitability, availability, or quality.
  • No Legal or Professional Advice: The AI Concierge does not provide legal, medical, or any other professional advice.
  • Data Usage: Your interactions with the AI Concierge may be used to improve the AI’s performance and personalize your experience, in accordance with our Privacy Policy.

10. Intellectual Property

All content on the Platform, including text, graphics, logos, images, software, and the AI Concierge’s output (excluding content provided by Suppliers), is the property of ExperiaHub or its licensors and is protected by intellectual property laws. You may not use, reproduce, or distribute any content from the Platform without our express written permission.

11. Disclaimers and Limitation of Liability

  • “As Is” Basis: The Platform and all Activities are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied.
  • Supplier Responsibility: ExperiaHub is not responsible for the acts, errors, omissions, representations, warranties, breaches, or negligence of any Suppliers or for any personal injuries, death, property damage, or other damages or expenses resulting therefrom.
  • Third-Party Services: ExperiaHub is not responsible for the performance or reliability of third-party services (e.g., Bokun, payment gateways, internet service providers).
  • AI Limitations: While our AI Concierge is designed to be helpful, ExperiaHub is not liable for any inaccuracies, omissions, or misinterpretations by the AI. Users are responsible for verifying all Activity details before booking.
  • Limitation of Liability: To the maximum extent permitted by law, ExperiaHub shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Platform; (b) any conduct or content of any third party on the Platform; (c) any content obtained from the Platform; or (d) unauthorized access, use, or alteration of your transmissions or content.

12. Indemnification

You agree to indemnify, defend, and hold harmless ExperiaHub, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees and costs, arising out of or in any way connected with (a) your access to or use of the Platform; (b) your violation of these Terms; (c) your violation of any third-party right, including without limitation any intellectual property right, publicity, confidentiality, property, or privacy right; or (d) any dispute or issue between you and any third-party Supplier.

13. Privacy Policy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding the collection, use, and disclosure of your personal information.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Taiwan (Republic of China), without regard to its conflict of law principles. You agree that any legal action or proceeding arising out of or relating to these Terms or your use of the Platform shall be exclusively brought in the competent courts located in Taiwan.

15. Changes to Terms

We reserve the right to modify these Terms at any time. If we make changes, we will notify you by revising the “Last Updated” date at the top of these Terms and, in some cases, we may provide you with additional notice (such as adding a statement to our homepage or sending you an email notification). Your continued use of the Platform after any such changes constitutes your acceptance of the new Terms.
